Terms of Service

These terms cover both the marketing site at lawnspools.com and the LawnsPools app at app.lawnspools.com. By using either, you agree to these terms. If you don't agree, don't use the service.
LawnsPools is operated by Jolt IT LLC. In these terms, "we", "us", and "LawnsPools" all mean Jolt IT LLC. "You" means the person or business using the service.
1. The service
LawnsPools is a cloud-based CRM and marketing automation tool for landscaping and pool service businesses. It helps you track leads, manage contacts, schedule jobs, send SMS and emails to your customers, and collect reviews.
2. Your account
- You need to be 18 or older and have the authority to bind the business you're signing up on behalf of.
- Account information must be accurate and kept current.
- You're responsible for what happens under your account, including anything your teammates do.
- Keep your password to yourself. Tell us immediately if you think your account has been compromised.
- One account per business. Don't share accounts or resell access.
3. Free trial and subscriptions
LawnsPools is a subscription service billed through Stripe.
- Free trial: new accounts get a 14-day free trial. A valid payment method is required to start the trial. We will not charge the card during the trial.
- Billing: at the end of the trial, your card is charged for the plan you selected (monthly or yearly). Subscriptions renew automatically for the same billing period unless you cancel.
- Cancellation: you can cancel any time before the trial ends to avoid being charged. You can cancel a paid subscription any time; cancellation takes effect at the end of the current billing period.
- Refunds: monthly plans are not refunded for partial months. Yearly plans are eligible for a prorated refund within the first 30 days of a new billing period, at our discretion, if you email us and explain the situation.
- Price changes: we may change prices. We'll give you at least 30 days' notice by email before a new price takes effect on your account.
- Failed payments: if your card fails, we'll retry and send you a notice. If payment keeps failing, your account may be suspended or canceled.
All payments are processed by Stripe under their terms.
4. Your data and your customers' data
You own the content you put into LawnsPools — your lead list, your contact records, your job notes, the messages you send. We hold it for you and don't claim any ownership of it.
When you invite us to act on your customer data (for example, sending an SMS via Twilio, or syncing leads from Google Local Services Ads), you're authorizing us to share the necessary details with those third parties to complete the task. See the Privacy Policy for who we share what with.
You confirm that:
- You have the legal right to store and process the customer data you put into LawnsPools.
- You've collected the necessary consents from your customers, especially for SMS and marketing emails (TCPA, CASL, and similar laws apply to you, not to us).
If you ask us to delete your account, we'll delete your data within a reasonable time, subject to legal retention requirements (tax records, etc.).
5. Acceptable use
Don't use LawnsPools to:
- Send spam, phishing, or any communication the recipient did not consent to.
- Store or send content that's illegal, abusive, harassing, or infringing.
- Reverse engineer, copy, or resell the service.
- Interfere with the service — no scraping, no probing for vulnerabilities without written permission, no attempting to exceed the rate limits.
- Pretend to be someone you're not.
We may suspend or close accounts that violate these rules, with or without notice.
6. Our intellectual property
LawnsPools — the software, the design, the wordmark — belongs to us. You get a limited, non-exclusive, non-transferable license to use it while your account is active and paid up. You don't get to copy, modify, or redistribute it.
7. Third-party services
LawnsPools integrates with Stripe, Google, Microsoft, Meta, Twilio, and others. Your use of those services through us is also governed by their terms. We're not responsible for outages or changes on their end.
8. Availability
We aim for high uptime, but we don't offer a formal SLA on the free trial or basic plans. Scheduled maintenance will be announced in advance where possible. Unplanned outages will be fixed as fast as we can.
9. Disclaimer
The service is provided "as is". We don't warrant that it will be uninterrupted, error-free, or that it will generate any specific business result for you. Conversion rates, example numbers, and case studies shown in marketing are based on aggregate pilot data and are not a guarantee for your business.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or related to the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.
11. Indemnification
You agree to defend and indemnify us against claims arising from (a) your use of the service in violation of these terms, (b) content you upload or send through LawnsPools, or (c) your violation of any law — in particular, SMS and email consent laws.
12. Termination
You can cancel your account at any time via the billing page (or by emailing support). We can suspend or terminate your account if you violate these terms, if required by law, or if we stop offering the service (with 60 days' notice and a prorated refund of any unused prepaid period).
13. Changes to these terms
We may update these terms. Material changes will be emailed to account holders at least 30 days before they take effect. Continuing to use the service after changes take effect means you accept the new terms.
14. Governing law
These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Travis County, Texas.
